Terms of Service
These terms apply to Hibiscus, a camera and color app for iPhone, and to this website. By using Hibiscus, you agree to use it responsibly and only with photographs and other content you have the right to process.
1. Using Hibiscus
You may use Hibiscus for lawful personal or commercial photography and color work. You are responsible for complying with applicable laws, platform rules, and the rights of others.
2. Your photographs and exports
You remain responsible for photographs and other content you import, capture, edit, share, or export. You must have the rights and permissions necessary to process and distribute that content. Hibiscus does not claim ownership of your photographs or exports.
3. Open-source software and brand assets
The covered Hibiscus source code is available on GitHub. It is licensed under the Mozilla Public License 2.0. Repository: T-1234567890/hibiscus-app.
The MPL-2.0 governs the Covered Software and the source-code rights it grants. It does not, by itself, govern your access to the separately distributed Hibiscus application package. App Store and TestFlight binaries may be distributed under separate end-user terms to the extent permitted by the MPL-2.0, while the MPL-2.0 rights and obligations applicable to the Covered Software remain in force.
A copy obtained through the App Store is also subject to Apple’s Standard End User License Agreement and applicable Usage Rules unless a Custom EULA is provided. A pre-release copy obtained through TestFlight is additionally subject to Apple’s TestFlight Terms and Conditions and is provided for time-limited beta testing.
Unless explicitly stated otherwise, the Hibiscus name, app icon, logos, visual identity, screenshots, and other brand or marketing assets are not licensed under the MPL-2.0. Forks and redistributed versions should use their own branding and must not cause confusion about whether an unofficial build is the official Hibiscus app or is endorsed by the owner.
4. Third-party services and links
Hibiscus and this website may link to third-party destinations including GitHub, Discord, app stores, sharing destinations, and other project pages. Those services operate under their own terms and policies. A link does not imply endorsement by or of the third party.
5. Availability and changes
Hibiscus may change over time as features are added, removed, improved, or limited. The application or website may become temporarily unavailable, and system requirements or distribution availability may change.
6. No warranty
To the maximum extent permitted by applicable law, Hibiscus and this website are provided “as is” and “as available,” without warranties of any kind. Nothing in these terms excludes rights or warranties that cannot legally be excluded.
7. Limitation of liability
To the maximum extent permitted by applicable law, Hibiscus and its developer are not liable for indirect, incidental, special, consequential, exemplary, or lost-data damages arising from use of or inability to use the application or website. This limitation does not apply where liability cannot legally be limited.
